Effective Date: 1st October 2025
These Terms and Conditions (“Terms”) set out the agreement between Oceanpointe Utilities Ltd. (“OUL”, "company", “we”, “us”, “our”) and the customer (“you”, “your”) for the provision of sewage treatment services in Jamaica. By applying for or continuing to use our services, you agree to comply with these Terms.
1.1 Service is provided subject to regulatory approvals.
1.2 OUL is responsible for the operation and maintenance of the main sewage network and treatment plants.
1.3 You are responsible for the upkeep of all internal sewer pipes and fixtures up to the point of connection with OUL’s system.
2.1 All Oceanpointe homeowners require a completed application form, and payment of the applicable deposit fee.
2.2 Unauthorized or illegal connections are strictly prohibited and may result in disconnection, penalties, and/or legal action.
2.3 Residential Rates will apply to the Service provided under the following conditions, that is, in a private residence used for residential purposes only.
2.4 Commercial rates will apply to all other uses not covered in 2.3
2.5 Connection approval is at the sole discretion of OUL, subject to technical feasibility and compliance with national regulations.
3.1 Only domestic or approved commercial wastewater may be discharged into the OUL system.
3.2 Prohibited materials include grease, oils, plastics, solvents, industrial chemicals, non-biodegradable substances, and hazardous waste.
3.3 Customers must not interfere with or damage OUL’s equipment, pipes, or infrastructure.
4.1 Bills are issued monthly (or as otherwise notified) in accordance with rates approved by the Office of Utilities Regulation (OUR).
4.2 Payment is due on receipt, and must be paid within 15 days of the bill date.
4.3 Failure to receive a bill will not entitle the consumer to the remission of any charge for non-payment within the time specified.
4.4 The fact that a Security Deposit has been made, shall in no way relieve the Customer from complying with the company’s requirements as to prompt payment of bills on presentation, nor, shall it constitute a waiver of the regular practices of the company providing for the discontinuance of Service for non-payment of any sum due to the Company.
4.5 Late or missed payments may result in:
4.6 Accepted payment methods include: bank transfers and deposits, as well as credit cards over the Stripe payment portal (2.9% service charge will be added).
5.1 Service rates and tariffs are subject to periodic review and approval by the OUR.
5.2 Additional charges may apply for:
6.1 OUL may temporarily suspend services for maintenance, upgrades, or emergencies.
6.2 Where possible, advance notice will be given for planned outages.
6.3 OUL shall not be held liable for damages or losses arising from service interruptions beyond its reasonable control (including natural disasters and force majeure events).
7.0 Invoices & Payments
· Invoices are issued on the 15th of the month
· Invoices are due by the 30th of the month
· Invoices are overdue after 15 days
OUL may suspend or discontinue sewage treatment under the following circumstances:
7.1 Disconnection for Non-Payment
· Customers with Security Deposits
· Customers with no Security Deposits
7.2 Failure to Provide Security Deposit or Guarantee
· Where a deposit, advance payment, or other form of security is required and not furnished within the time requested, the following disconnection timeline prevails.
· OUL may also require an increased deposit where a customer has been disconnected for non-payment more than twice in 12 months.
7.3 Fraudulent or Illegal Use of Service
· Evidence of tampering, unauthorized connections, or diversion of wastewater flows.
· Discharge of prohibited substances into the system (e.g. grease, oils, chemicals, non-biodegradable or hazardous waste).
7.4 Health, Safety, and Environmental Risks
· Where the customer’s internal plumbing or drainage creates hazardous conditions, unsanitary discharges, or risks to public health.
· Where discharges are in breach of environmental standards set by the National Environment and Planning Agency (NEPA).
7.5 Violation of Terms & Conditions
· Where the customer violates these Terms & Conditions and fails to remedy the violation within ten (10) days of written notice from the Company.
7.6 Customer Request
· At the written request of the customer, subject to payment of all outstanding balances and adherence to minimum contractual terms.
Service will only be restored once the following conditions are met:
· Settlement of all outstanding bills, charges, and applicable late fees.
· Payment of a reconnection fee as set out in the OUL’s approved tariff schedule.
· Remedy of any hazardous conditions or breaches (including plumbing repairs, removal of prohibited discharges, or compliance with NEPA standards).
· Provision of any required deposit, security, or guarantee for future service.
In cases of repeated violations, the OUL reserves the right to impose stricter terms or deny reconnection until compliance is assured7. Discontinuance of Service
You agree to:
10.1 Complaints should first be submitted to the OUL’s Customer Service Department.
10.2 If unresolved, disputes may be escalated to the Office of Utilities Regulation (OUR).
10.3 Customers must continue to pay undisputed charges while disputes are being reviewed.
11.1 OUL operates under permits issued by the National Environment and Planning Agency (NEPA) and is required to meet national effluent discharge standards.
11.2 Customers producing industrial or non-domestic wastewater must comply with NEPA pre-treatment requirements.
11.3 Non-compliance may result in service suspension, fines, or regulatory enforcement.
12.1 OUL is not responsible for:
13.1 Customer information will be used solely for billing, service management, and compliance with legal or regulatory requirements.
13.2 Data will not be shared with third parties except as required by law.
14.1 The Company reserves the right to update these Terms with approval from the OUR.
14.2 Customers will be given 30 days’ notice of any material changes.
